Electronic judicial domicile – Changes deadlines and rules

by Patricia Medeiros Barboza and Marcos D’Angelo

The National Council of Justice (CNJ) made changes to Resolution 455/2022 regarding the use of the Electronic Judicial Domicile (DJE), reducing the risk for companies related to legal deadlines.

Previously, companies could access communications intended for the lawyers representing them in the proceedings, which could cause confusion about the date of acknowledgment of the procedural communication, and risk of missing deadlines.

With the new rule, when the law does not require personal service or notification (i.e., a direct communication with the party, not with their representing lawyers), the deadlines will be counted from the respective publication in the National Electronic Justice Gazette (DJEN), and only personal citations and notifications will be made available directly in the DJE.
