ANPD endurece fiscalização sobre dados de crianças e adolescentes

A Agência Nacional de Proteção de Dados (ANPD) aplicou multa de aproximadamente R$ 153,7 milhões a uma das maiores plataformas globais de rede social de vídeos, além de determinar a eliminação de dados pessoais de adolescentes cadastrados na plataforma, após identificar irregularidades no tratamento de tais dados. A decisão, proferida em primeira instância administrativa e ainda sujeita a recurso, foi publicada no Diário Oficial da União em 25 de agosto de 2026 e divulgada pela ANPD em seu site.

Segundo a ANPD, as infrações ocorreram tanto na experiência disponibilizada sem a criação de conta quanto naquela vinculada a perfis cadastrados e envolveram:

• tratamento de dados pessoais sem hipótese legal válida;
• insuficiência das medidas destinadas a prevenir o tratamento de dados de crianças e adolescentes; e
• ausência de demonstração de medidas técnicas e organizacionais eficazes para assegurar o cumprimento de normas de proteção de dados pessoais.

As sanções foram fundamentadas em violações aos princípios da prevenção, responsabilização e prestação de contas previstos na Lei Geral de Proteção de Dados Pessoais (LGPD), bem como à necessidade de enquadramento do tratamento em hipótese legal válida.

A análise da ANPD apresentada em Nota Técnica também reforça que mecanismos baseados exclusivamente na autodeclaração de idade podem ser insuficientes quando não acompanhados de medidas complementares mais robustas e alinhadas aos riscos da atividade. Para a ANPD, a proteção desse público exige medidas preventivas, efetivas e demonstráveis, estruturadas desde a concepção dos produtos e serviços, especialmente diante do princípio do melhor interesse da criança e do adolescente previsto no artigo 14 da LGPD.

Embora as penalidades tenham sido aplicadas com fundamento na LGPD, e não no Estatuto Digital da Criança e do Adolescente – o chamado “ECA Digital” – a decisão sinaliza um endurecimento da fiscalização sobre serviços digitais utilizados por crianças e adolescentes. Nesse sentido, o Conselho Diretor da ANPD, ao aprovar o plano de conformidade apresentado pela regulada, determinou que este deverá observar as exigências do ECA Digital sobre mecanismos confiáveis de aferição de idade, conforme o respectivo cronograma de implementação e as orientações regulatórias da Agência.

A atuação da ANPD indica que a proteção infantojuvenil ocupa posição cada vez mais central em sua agenda regulatória e fiscalizatória e o alerta é claro: a conformidade com a LGPD e o ECA Digital deverá ser demonstrada por medidas concretas, documentadas e comprovadamente eficazes.

ANPD intensifies enforcement regarding children’s and adolescents’ data

The Brazilian Data Protection Agency (ANPD) imposed a fine of approximately BRL 153.7 million (around USD 29.9 million) on one of the world’s largest video-sharing social media platforms and ordered the deletion of personal data relating to adolescents registered on the platform, after identifying irregularities in the processing of such data. The decision, which was issued at the first administrative instance and is still subject to appeal, was published in the Federal Official Gazette on August 25, 2026, and was announced by the ANPD on its website.

According to the ANPD, the infringements occurred in connection with the user experience made available both without account creation and with registered user profiles, and involved:

• processing of personal data without a valid legal basis;
• insufficient measures to prevent the processing of children’s and adolescents’ data; and
• failure to demonstrate effective technical and organizational measures to ensure compliance with personal data protection rules.

The sanctions were based on violations of the principles of prevention, liability and accountability set forth in the Brazilian General Data Protection Law (LGPD), as well as the requirement that processing activities rely on a valid legal basis.

The ANPD’s analysis, as set forth in a Technical Note, further emphasizes that mechanisms based exclusively on self-declared age may be insufficient where they are not accompanied by more robust supplementary measures commensurate with the risks inherent to the relevant activity. In the ANPD’s view, protecting this group requires preventive, effective, and demonstrable measures embedded in products and services by design, particularly in light of the principle of the best interests of children and adolescents established under Article 14 of the LGPD.

Although the penalties were imposed under the LGPD rather than under the Digital Statute for Children and Adolescents, the so-called “Digital ECA,” the decision signals a more stringent enforcement approach toward digital services used by children and adolescents. In this regard, when approving the compliance plan submitted by the regulated entity, the ANPD’s Board of Directors determined that the plan must comply with the Digital ECA requirements concerning reliable age-assurance mechanisms, in accordance with the applicable implementation timetable and the ANPD’s regulatory guidance.

The ANPD’s actions indicate that the protection of children and adolescents is assuming an increasingly central role in its regulatory and enforcement agenda. The message is clear: compliance with the LGPD and the Digital ECA must be demonstrated through concrete, documented, and demonstrably effective measures.
